How do I go about proving that estimates and repairs to damage done in a rental property were necessary?

Water damage has been done to a landlord's property by a tenant with no insurance;the landlord has filed a claim and now the tenant is held responsible for the total cost of the repairs done to the property. There is doubt whether the estimates and repairs were necessary to the amount of damage done. The tenant needs to prove that the repairs were over and above what was necessary and doesn't want to get stuck with paying back an overblown amount of money.

  1. talk about insurance rip off. that is why you pay a high premium. to answer your question. you need to get at least 3 quotes from contractors (4 is better) of the estimated damage, then submit that with the approximate lost of income that will occur while the repairs are being done (especially if it affects another unit). see if you can get your insurance to cover the cost(good luck on that), if not sue the tenant to get your money back (good luck on that too). The other way is to go after the tenant (see above) but cough up the cost until you can get your money back. if you do the later, you can always defer the cost against the income of the following months as an expense of operation.
  2. I'm not sure how you go about proving that the repeairs were necessary. You should probably consult with a lawyer if you haven’t already.
